A judgment is created when a court orders a business, individual, or institution to pay a sum of money to the plaintiff resulting from damages incurred by the plaintiff due to the actions of the defendant.
The sale of a commercial or consumer judgment provides an immediate payment of the judgment or the cash that the plaintiff may need during the appeal of the verdict and the payment of attorney fees.
Again, it is the creditworthiness and financial strength of the defendant that make the assignment and sale of the judgment to a funding source possible. However, it is very difficult to establish the valuation of a judgment and set a price, even when the assets of the defendant have been found and accessed.
